These Terms and Conditions ("Terms") govern your access to and use of our website, mobile-responsive web application, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

Important Note: OfCashy is a budgeting TOOL, not a financial advisor. We help you organize your data, but you are solely responsible for your financial decisions.

3.1 Eligibility
To use OfCashy, you must be at least 18 years old or the age of majority in your jurisdiction. By registering, you represent that you meet this requirement.

3.2 Account Responsibilities
You are solely responsible for:
- Maintaining the confidentiality of your password and login credentials
- All activities that occur under your Account
- Immediately notifying us of any unauthorized access or security breach

3.3 No Credential Sharing

You may not share your login credentials with any third party or allow unauthorized individuals to access your financial data. You are liable for any damages resulting from failure to secure your Account.

4. Service Description and Features

OfCashy provides a web-based budgeting platform allowing users to manage their financial life.

Service Limitations:
- We strive for 99.9% uptime but do not guarantee uninterrupted service
- We may perform scheduled maintenance with prior notice when possible
- We reserve the right to modify or discontinue features with reasonable notice. Material changes will be communicated via email or in-app notification.

5. Subscription Plans, Billing, and Payments

5.1 Pricing Structure

Pricings can be checked on home page or pricing related section on the website.

5.2 Billing Terms

Monthly Plans: Billed in advance on a recurring 30-day basis. Auto-renewal occurs unless cancelled before the renewal date.

Yearly Plans: Billed in advance for a 12-month period. Auto-renewal occurs unless cancelled before the renewal date.

5.3 Payment Processing
We use secure third-party payment processors (e.g., Stripe, PayPal, or Paddle). We do not store your full payment card details on our servers. By submitting payment information, you authorize us to charge the specified fees to your chosen payment method.

5.4 Price Changes
We may adjust pricing upon 30 days' advance notice. Price changes will not affect your current billing cycle but will apply upon renewal. Continued use after the effective date constitutes acceptance of the new pricing.

6. Cancellation and Refund Policy

6.1 Cancellation by You

You may cancel your subscription at any time via your Account Settings.

Cancellation takes effect at the end of your current billing period.

Upon cancellation, your Account will revert to the Free Plan limitations at the start of the next billing cycle.

You will retain access to Pro/Business features until the end of your paid period.

6.2 Refund Policy

Monthly Plans: No refunds for partial months. You may cancel anytime to avoid future charges.

Yearly Plans: We offer a 30-day money-back guarantee for annual subscriptions. If you cancel within 30 days of your initial yearly purchase, you will receive a full refund.

Free Plan: No refunds applicable.

6.3 Cancellation by Us (Suspension/Termination)
We may suspend or terminate your Account immediately if you:
- Violate any provision of these Terms
- Fail to pay outstanding fees within 14 days of a payment failure notice
- Engage in conduct that harms our Service, other users, or our reputation

Upon termination, we will delete your Financial Data within 30 days, unless required to retain it by law.

7. Financial Data: Ownership, Privacy, and Security

7.1 You Own Your Data
All Financial Data you upload, create, or store on OfCashy remains your exclusive property. We claim no ownership over your data.

7.2 Our License to Operate
By using the Service, you grant us a limited, revocable, non-exclusive license to access, store, and process your Financial Data solely to provide and improve the Service. This license terminates when you delete your Account.

7.3 No Financial Advice Disclaimer
OF CASHY IS NOT A FINANCIAL ADVISOR OR BROKER. We do not provide investment advice, tax advice, or any form of financial planning recommendations. The budgeting tools, reports, and analytics are for informational purposes only.

You acknowledge that:
- You are solely responsible for your financial decisions
- OfCashy does not guarantee that using our Service will improve your financial situation
- You should consult a certified financial professional for personalized advice

7.4 Data Security
We implement industry-standard security measures including:
- AES-256 encryption for data at rest
- TLS 1.3 encryption for data in transit
- Regular security audits and penetration testing

However, no method of transmission over the Internet is 100% secure. You use the Service at your own risk.

7.5 Data Retention

Active Accounts: Your data is retained as long as your Account remains active.

Deleted Accounts: We permanently delete your Financial Data within 30 days of Account deletion. We may retain anonymized, aggregated data for analytics purposes that cannot identify you.

10. Intellectual Property

10.1 Our IP
All content on OfCashy excluding your Financial Data, including the code, design, logos, text, graphics, and "look and feel" is owned by OfCashy and protected by copyright and trademark laws.

10.2 Restrictions
You may not:
- Copy, modify, or reverse-engineer any part of the Service
- Use our trademarks without written permission
- Resell or redistribute access to the Service without a white-label agreement

11. Disclaimer of Warranties

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. To the fullest extent permitted by law, OfCashy disclaims all warranties, whether express or implied, including:

12. Limitation of Liability

Our total aggregate liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $0 if you are on the Free Plan.

12.3 Exceptions
Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability for fraud, death, or personal injury caused by our negligence.

You agree to indemnify, defend, and hold harmless OfCashy and its team members from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

- Any dispute between you and your financial institutions regarding data access

We reserve the right to update these Terms periodically to reflect changes in our Service, legal requirements, or industry best practices.

- We will also display an in-app notice upon login
- Changes become effective 30 days after notice for existing users
- Changes are effective immediately for new users registering after the effective date

Opt-out Right: If you do not agree to the revised Terms, you may cancel your Account before the changes take effect. Continued use constitutes acceptance.

We shall not be liable for delays or failures in performance resulting from causes beyond our reasonable control, including but not limited to:
